The Brennan Center Jorde Symposium: David Strauss
David Strauss of the University of Chicago Law School presented "Polarization, Victimization, and Judicial Review" at the Brennan Center Jorde Symposium at Yale Law School on March 10, 2025. Commentators were Amna Akbar of Ohio State University Moritz College of Law, Ryan Doerfler of Harvard University, and Moshe Habertal of NYU School of Law.
Strauss explored how a version of judicial review that has been successful in the past — based on the understanding that courts will intervene when people are unfairly excluded from democratic politics — threatens, today, to become a destructive competition among groups claiming the status of victims.
